how is walking away from a cop who has told you that you are under arrest NOT resisting arrest?

and how do you go about arresting the said person who is walking away without using force?

do you see the slippery slope this presents if it is ok to use force on someone who walks away? what if they just turn their head? what if they just say no? should force be reserved for when the other side is attempting the same? when is a cop going too far? this is an old woman here, not some 19 year old black man (seth).

simple fact of life (and american government): once you lose a freedom you will never get it back, and everything acceptable has a gray area that is also acceptable because they are the government. (dan will not im a huge faggot, he believes in the law and the government, and thats fine. i sometimes wish i still had faith in people).

on one hand, i agree with dan that being an old woman does not excuse you from being a cunt to a police officer, or to anyone in general. on the other hand, there are much less painful ways he could have used "force" to carry on with his arrest. i mean it is an old woman, just pick her up and put her in the car.

Im not a cop (yet) and dont plan on doing street level enforcement unless I win the lotto or something, but I am not saying that the officer was 100% right in how he handled the situation, just that on the scale of justifiable force he went through his progression up to using a taser, which until recently it would of been something like a baton which causes much more harm than a taser. If he was abusing his power than I am all for punishing or dismissing/charging the officer, you should know that is how I feel by now (I would hope). I somewhat agree and disagree with the having no reason to tazer an old women, and the only reason I said that the walking away was resisting arrest was because the officer had already said she was under arrest, and once you are under arrest you are not free to walk away, or do anything the officer does not instruct you to...not saying its 100% right, but thats how the law is written. If he had not told her she was under arrest, tasering her for walking away towards her car is 100% uncalled for and wrong.

I think I explained the use of force thing above, but if the officer had not told her she was under arrest his actions were not justified in the slightest and should be punished. Once you lose a freedom is it very hard if ever to get back, I agree...hence why I did not think the patriot act was all good at the time. And tbh I dont quite get the grey area comment, could you explain it alittle more pliz

Yeah but picking up someone who is telling you not to touch her, and etc you follow the use of force charts that are department policy, and I dont think that you would find picking up an old lady and tossing her into the back seat on them anywhere :donno:

what if the cop tells her she is under arrest and she just does not move, like claiming ignorance? would the use of force then be admissible?

Cop: Your under arrest
Lady: Ok
Cop: put your hands on the hood of the car and dont move, do you have anything dangerous in your pockets before I search them?
Lady: What do you mean, should I move?

I dont get your example joe :donno:

If a cop did that, it would not be justified. If the officer does not make it clear through explanation what he wants done then he should not be an officer. I would lol though if the chick bent over and spread the wrong ones ;)

im sure to the letter of the law the cop was justified
but i dont think anyone could argue it was necessary, or required in the situation. so if its not needed, isnt it abuse of power, regardless of if the letter of the law says its ok?

the law is abuse of power in many cases, but what im saying is common sense is > the law
and i never said justifiable, nor would i ever say it is in this exact case

basically, my thoughts are that any "force" from police officers should only be used if he or she feels that the safety of themselves or others are in immediate danger

other than that, i shit my pants

a law is conceived in sense, but put into practice by politicians who get paid by lobbiest(sp?) and judges who have agendas.

you say justified because she ignored him, i say force should only be used when force is used against.

Both of them are douche bags though.

The situation could of been handled better, I agree.

how is walking away from a cop who has told you that you are under arrest NOT resisting arrest?

and how do you go about arresting the said person who is walking away without using force?

do you see the slippery slope this presents if it is ok to use force on someone who walks away? what if they just turn their head? what if they just say no? should force be reserved for when the other side is attempting the same? when is a cop going too far? this is an old woman here, not some 19 year old black man (seth).

simple fact of life (and american government): once you lose a freedom you will never get it back, and everything acceptable has a gray area that is also acceptable because they are the government. (dan will not im a huge faggot, he believes in the law and the government, and thats fine. i sometimes wish i still had faith in people).

I think I explained the use of force thing above, but if the officer had not told her she was under arrest his actions were not justified in the slightest and should be punished. Once you lose a freedom is it very hard if ever to get back, I agree...hence why I did not think the patriot act was all good at the time. And tbh I dont quite get the grey area comment, could you explain it alittle more pliz

on one hand, i agree with dan that being an old woman does not excuse you from being a cunt to a police officer, or to anyone in general.  on the other hand, there are much less painful ways he could have used "force" to carry on with his arrest.  i mean it is an old woman, just pick her up and put her in the car.

Yeah but picking up someone who is telling you not to touch her, and etc you follow the use of force charts that are department policy, and I dont think that you would find picking up an old lady and tossing her into the back seat on them anywhere :donno:

I commend you for being a good man.
